Parent Visa

The Parent Visa program is designed for the parents of children who are Australian Citizens, Permanent Residents or eligible New Zealand citizens, to be sponsored to live permanently in Australia.

To be eligible, parents must:

  • Be sponsored by their child;
  • Meet character and health requirements; and
  • Meet the Balance of Family Test. This test requires half or more of your children to be living in Australia, either as an Australian citizen or permanent resident.

The current parent visa pathways can be a longstanding and expensive process. Depending on the visa category, an application can take two years for a Contributory Parent visa or up to 30 years for a non-Contributory Parent visa to Depending on the visa category, an application can take more than 30 years to be granted.

As an Australian Citizen, Permanent Resident or eligible New Zealand citizen, you may be able to sponsor immediate family members such as children, parents and other extended family to migrate to Australia.

Administrative Appeals Tribunal

Under the Migration Act 1958 you are entitled to apply to the Administrative Appeals Tribunal (AAT) for a merits review of an application that has been refused by the Department of Immigration and Boarder Protection.

The AAT is responsible for the review of administrative decisions made under Commonwealth laws and has the power and jurisdiction to change migration and refugee visas and visa-related decisions.

If you have had a visa cancelled or refused, please contact us for assistance. It is important not to delay your appeal. The review period is prescribed in law, and a request for review can only be made within 21 days after your application has been refused.
